A.T.A 까르네란 A.T.A 관세협약에 따른 일시수입통관증서를 말합니다.

이 협약은 가입국 간에 일시적으로 수출입되는 물품에 대해서는 A.T.A까르네라는 증서를 통해 간이한 통관절차를 적용해 주겠다는 것이 주요 골자인데요. 증서가 발급되면 관세 등 세금 납부없이 일시 수입이 가능하기 때문에 협약에서 정한 자만 발급할 수 있도록 규정하고 있습니다.
오늘은 까르네를 발급할 수 있는 주체에 대해서 정리해 보았습니다.
[1] 까르네 보증단체
보증단체란 A.T.A.까르네를 이용하여 수출 또는 수입된 물품에 대하여 같은 물품이 일시수출입 또는 보세운송의 조건을 준수하지 않는 경우에 협약에 따라 관세등 수입에 관련된 부과금을 세관에 납부할 책임이 있는 단체를 말합니다.
까르네증서를 이용하여 물품을 수입하게 되면 해당 증서를 근거로 수입물품에 부과되는 관세 등 세금이 면제되는데요.
증서가 있다면 세금이 면제될 수 있기 때문에 이 증서의 효력과 신뢰성을 보증할 수 있는 주체가 있어야 합니다. 이것을 바로 보증단체라고 하죠.
까르네 증서에 문제가 있거나 수출입자가 까르네 협약에 따른 절차를 준수하지 않아 세금 면제조건을 충족하지 않는 경우 수입국의 세관은 면제한 세금을 이 보증단체에게 요구할 수 있습니다.
증서 보증에 대해서는 협약 제6조에서 규정하고 있습니다.
물품의일시수입을위한일시수입통관증서에관한관세협약 제6조 (보증)
1. 각 보증 단체는 해당 발급단체에 의해 발급된 A.T.A. 까르네에 의하여 동 국가에 반입된 물품에 관하여, 일시 수입 또는 보세 운송의 조건을 준수하지 않는 경우에 지불하는 수입세 및 기타 금액을 그 보증단체가 설립되어 있는 국가의 관세당국에 지불할 책임을 져야 한다. 보증단체는 그러한 금액의 지불에 대하여 위에 언급한 금액을 부담해야 할 인과 연대적 및 단독적으로 채무를 져야 한다.
2. 보증 단체의 책임은 수입세액을 10%이상 초과할 수 없다.
3. 수입국의 관세당국이 특정 물품에 관하여 A.T.A. 까르네를 무조건 취소해 버린 경우 동 관세당국은 동 물품에 관하여 본조 제1항에 언급된 금액에 대한 지불을 보증 단체에 대해 더 이상 청구할 수 없다. 그럼에도 불구하고 그 까르네의 취소가 부당하게 또는 허위로 이루어졌거나 일시수입 또는 보세운송의 조건에 위반이 있었다는 사실이 사후에 발견될 경우에는 여전히 보증단체에 대해서 청구할 수 있다.
4. 관세당국은 까르네 유효기일 만료일로부터 1년 이내에 보증단체에 대하여 청구하지 않는 경우에는 어떠한 경우에도 본조 1항에 언급된 금액의 지불을 보증단체에 요구할 수 없다.
그렇다면 까르네증서 자체도 보증단체에서 발행할까요?
그건 아닙니다.
협약과 우리나라 고시에서는 까르네 보증단체와 발급단체의 정의를 나누어서 규정하고 있습니다.
보증단체는 앞서 정리한 바와 같이 까르네 증서를 이용하여 수입된 물품에 대해 협약에서 규정한 조건을 준수하지 않는 경우 면제된 세금을 납부할 책임이 있는 단체이고요. 발급단체는 보증단체의 책임으로 까르네증서를 발급할 수 있도록 인가받은 단체로 정의하고 있습니다.
즉, 발급한 증서로 인해 문제가 발생했을 경우 책임은 보증단체에 있지만 증서의 발급은 발급단체가 한다는 건데요.
그러면 보증단체만 너무 억울한 거 아니냐 하실수도 있는데 사실 대부분의 국가에서 보증단체와 발급단체를 동일하게 정해놓고 있습니다. ㅎㅎ
우리나라의 경우 A.T.A까르네에 의한 일시수출입통관에 관한 고시에서 확인하실 수 있는데요.
바로 대한상공회의소입니다.
Ａ.T.Ａ.까르네에의한일시수출입통관에관한고시 제5조(보증단체)① A.T.A.까르네에 의한 물품의 일시수입 또는 보세운송되는 물품에 대한 관세등을 보증할 수 있는 자는 관세청장의 인가를 받은 다음 각 호의 단체로 한다.
